Find the appropriate court* for your State/Territory
and register your details for an online account.

STAGE 1

START YOUR ONLINE APPLICATION

Sole Applicant - You are the "Applicant", the other party is the "Respondent"
Fill in all the details and print your application.

STAGE 2

GET THE APPLICATION WITNESSED

Take application to a Licenced Lawyer or Justice of the Peace to have the documents witnessed.
Do not sign the documents until you are in the presence of the witness.

STAGE 3

UPLOAD TO THE PORTAL

Scan the document as a PDF and upload them to the online court portal.
Login, find your case, upload documents. A "Sealed" copy becomes available to be served on the other party.

STAGE 4
FIND SOMEONE TO SERVE THE OTHER PARTY Using a licenced Process Server, friend or a family member that is over the age of 18 and willing to fill an "Affidavit of Service" once the documents have been served.
NOTE; you can not personally serve the documents yourself.
You can email or post via registered mail but the Respondent MUST sign the "Acknowledgement of Service".
STAGE 5
SERVE THE DOCUMENTS ON THE OTHER PARTY Note the time, date and address that the other party was given the documents
Attempt to get them to sign an "Acknowledgement of Service".
STAGE 6
COMPLETE THE AFFIDAVIT OF SERVICE

The person who served the documents is the "Deponent" and must fill the form in with the details of how service was conducted and how the respondent was identified.
They are known to the server, matched a photograph supplied to the server, or the respondent signed the acknowledgement of service witnessed by a Lawyer or a Justice of the Peace.

STAGE 7
PROOF OF ID OR PROOF OF SIGNATURE

The applicant fills in the affidavit for proof of identity
(if the respondent was identified via photograph or proof of signature, if they signed the Acknowledgement of Service).

STAGE 8
UPLOAD TO THE PORTAL

Scan document as a PDF and upload them to the online court portal
Login, find your case, upload documents.
Await your hearing date.
